Working with a paralegal: clear scope, instructions and expectations.

A consultation is not automatically a retainer. The relationship begins only after the accepted services, responsibilities, fees and limits are confirmed. Early disclosure of every deadline and document helps protect the file.

Before Ghasedak can accept the file

    Provide the full legal names of every party so a conflict check can be completed.

  2. 02

    Send the ticket, claim, application, notice, order, hearing notice or other document that creates the next deadline.

  3. 03

    Explain the history honestly, including unfavourable facts, prior advice, missed steps, settlements and related proceedings.

  4. 04

    Ghasedak reviews jurisdiction, licence scope, competence, deadline capacity and whether the requested service is proportionate.

  5. 05

    No representation begins until acceptance is confirmed and any required written retainer and financial terms are completed.

The written retainer and fees

Scope

The agreement identifies the matter and work included, excluded or dependent on a later decision.

Fees

The agreement explains whether work is hourly, fixed-fee or another permitted arrangement, plus HST and disbursements.

Trust and billing

Any advance, trust condition, invoice schedule and treatment of unused funds should be stated clearly.

Ending the retainer

The agreement explains completion, withdrawal, termination, transfer of the file and final accounting.

What the client must do

    Keep contact information current and read communications promptly.

    Meet every deadline for instructions, documents, payment and attendance.

  3. 03

    Preserve original records and do not alter messages, photographs, files or metadata.

  4. 04

    Do not contact the other party, witness, prosecutor or tribunal contrary to advice or a court order.

  5. 05

    Tell the paralegal immediately about new evidence, settlement contact, another charge, an order, a missed date or a change in goals.

Advice, decisions and communication

The paralegal explains options, risks and recommendations; the client makes informed decisions and gives instructions. Important instructions and settlement authority should be clear and documented. Legal professionals cannot guarantee a result or control the court, tribunal, prosecutor, opposing party or enforcement outcome.

Licence verification and concerns

Clients can verify a lawyer or paralegal in the Law Society directory. Questions about the retainer, invoice or service should first be raised promptly with the office. The Law Society also provides public complaint information and referral resources.
